Swedish Court Overturns Fine Against LeoVegas

A Swedish court recently ruled in favor of the online gambling operator LeoVegas, overturning a substantial fine initially imposed by Sweden’s gambling authority. The fine, amounting to 8 million SEK (approximately $854,000), had been levied by Spelinspektionen, the Swedish regulatory body, due to alleged shortcomings in LeoVegas’s responsible gambling measures.

Allegations of Insufficient Efforts to Curb Excessive Gambling

About a year prior, LeoVegas faced criticism when the regulator identified multiple cases of risky gambling behavior among its customers. Specifically, three individuals were noted for exhibiting signs of excessive play, including extended gaming sessions, substantial deposits, and sizeable losses in a short timeframe.

Spelinspektionen argued that LeoVegas relied too heavily on automated notifications and failed to intervene in a timely manner to prevent these customers from overspending. Despite LeoVegas’s operator in Sweden, Roar Vegas, defending their approach of using automated messages in line with industry standards, the regulator imposed the fine.

Court Decision Favors LeoVegas

Disputing the fine, Roar Vegas appealed the ruling, highlighting a lack of clear regulatory guidelines dictating when operators must escalate from automated warnings to direct human intervention. This ambiguity, they claimed, has caused confusion across the gambling industry.

The Administrative Court in Linköping reviewed the case and recognized that while improvements could be made, Roar Vegas acted promptly in initiating responsible gambling interventions. The court also acknowledged the unclear nature of the regulatory requirements and concluded that no definitive breach occurred.

Consequently, the court canceled the $854,000 fine. The gambling authority retains the right to challenge this ruling within a three-week period following the decision.

Previous Compliance Issues in the Netherlands

LeoVegas has faced similar regulatory challenges in the Netherlands, where the Kansspelautoriteit fined the company around $590,000 for inadequate player protection over an extended time. The Dutch regulator found that LeoVegas fell short in preventing excessive gambling activities among its users.
