NGCB Seeks Court Action Against Kalshi for Violating Gaming Regulations
Background of the Dispute Between NGCB and Kalshi
The Nevada Gaming Control Board (NGCB) has been engaged in a prolonged legal conflict with prediction markets platform Kalshi. Recently, the regulator escalated the matter by requesting that a Nevada state court hold Kalshi in contempt of court for allegedly disregarding legal orders.
NGCB’s Accusations Against Kalshi
The NGCB filed documents with Nevada’s First Judicial District Court, asserting that Kalshi has not implemented necessary geofencing technology required to restrict its services within the state. This failure constitutes noncompliance with a court directive issued on May 18, which bars Kalshi from offering sports betting activities in Nevada.
The board emphasized that Kalshi’s ongoing defiance is causing considerable harm to the state’s interests, including financial losses and unfair competition. Kalshi reportedly continues to accept bets worth hundreds of millions on major sporting events such as the NBA Finals, Stanley Cup Finals, and FIFA World Cup, without adhering to the stringent geofencing rules imposed on licensed Nevada sportsbooks.
NGCB stated this creates an uneven playing field that disadvantages licensed operators and undermines the integrity of Nevada’s gaming sector. Based on their investigation and Kalshi’s admissions of noncompliance, the regulators urged the court to impose contempt sanctions to ensure the company complies with the law.
NGCB’s Requests to the Court
The NGCB is seeking the court’s approval to hold Kalshi in contempt and to levy heavy penalties for violating the injunction. Potential measures include forfeiting all profits Kalshi earned from the disputed activities or imposing fines of up to $120,000 per day during the period of noncompliance.
Mike Dreitzer, the NGCB’s recently appointed chairman, stressed that the court had explicitly ordered Kalshi to cease offering contracts related to specific events within Nevada. Dreitzer affirmed the board’s commitment to rigorously enforcing state laws to uphold the reputation and legality of the gaming industry.
According to Dreitzer, contracts based on sports and other events qualify as wagers under Nevada law, necessitating appropriate licensing and regulatory supervision. Nevada’s lawmakers view the gaming industry as vital for the state’s economy and public welfare, and as such, they have instituted licensing and oversight rules aimed at protecting public interests including health, safety, and moral standards.
