Background of the Defamation Lawsuit

A legal conflict originating from a North Carolina local election has escalated, with defendants in a defamation case claiming the true issue is a political clash over casino development rather than damage to reputation.

Allegations and Political Context

Craig Travis, a former county commissioner, initiated the defamation lawsuit in 2024 after losing the Republican primary for a Board of Commissioners seat. Travis narrowly missed advancing, finishing just behind incumbent Kevin Berger in a competitive race. Following the election, he filed legal claims against several individuals and political groups, accusing them of spreading false and damaging statements about him during the campaign.

The lawsuit targets current and former county officials, a local political leader, and various conservative organizations. Defendants argue the case is baseless and primarily motivated by Travis’s opposition to regional casino expansion.

Defendants’ Position on the Lawsuit’s Motive

Defense attorneys emphasize that the lawsuit focuses heavily on the gambling industry’s influence, including lobbying efforts and political contributions, rather than specific defamatory remarks. They suggest the legal action serves a broader political purpose, with the named parties being incidental to the main conflict.

Efforts to Dismiss the Case

Defendants have pointed out that key players such as casino operators, lobbyists, and lawmakers are not defendants, despite their central role in the complaint’s narrative. They also note that early legal maneuvers by Travis sought information related to casino activities, not the alleged defamation.

Based on this, the defendants are urging the state Court of Appeals to uphold a prior dismissal of the case by a trial judge in 2025. The judge found no evidence of bias or merit in the claims. Travis challenged the dismissal, but the same judge refused to reconsider the decision.

Defendants now label the appeal as groundless and have asked for reimbursement of legal fees, characterizing the lawsuit as frivolous.

Travis’s Response and Ongoing Legal Battle

Travis insists that his lawsuit is warranted. His legal team has provided evidence of campaign materials and communications that they say inaccurately portrayed his record and character. Allegations involved issues such as tax policy, law enforcement funding, and personal conduct, which Travis maintains were false and harmed his campaign.

He further claims that negative messaging was coordinated and tied to his stance against a proposed casino project supported by local politicians.

The appeals court has not yet made a ruling, leaving the lawsuit’s outcome uncertain as both parties continue their legal arguments.
