The Netherlands is considering imposing stricter controls on gambling advertisements amid concerns that existing regulations may not adequately protect vulnerable players. Critics warn that tighter restrictions could inadvertently benefit illegal gambling operators, putting the licensed industry at a disadvantage.
Limitations of the Self-Exclusion System Recognized by Lawmakers
While untargeted gambling ads are already prohibited in the Netherlands, some lawmakers propose going further—potentially banning all forms of gambling advertising. This debate has intensified following parliamentary responses that highlighted weaknesses in the country’s safer gambling framework, particularly within Cruks, the national self-exclusion register.
State Secretary Claudia van Bruggen pointed out that operators cannot reliably confirm if individuals have self-excluded when they receive gambling advertisements, increasing the risk of exposing these vulnerable players to gambling promotions. Furthermore, the self-exclusion system does not cover unlicensed gambling sites, which continue to pose challenges.
Van Bruggen underlined the risks associated with exposing vulnerable people to gambling content, emphasizing the serious harm it could cause.
Industry’s View: Advertising Bans Could Harm the Legal Market
The Netherlands had already banned untargeted gambling advertisements in phases, including prohibiting sponsorship deals tied to programs, events, and sports teams. Advertisers must now adhere to strict measures designed to target only those who have shown interest in gambling. Despite these efforts, gaps remain that fail to fully protect at-risk gamblers.
Due to these shortcomings, lawmakers are exploring the possibility of more comprehensive limitations, potentially including a complete ban on gambling ads.
However, representatives from the regulated gambling sector caution that such a broad ban could damage their ability to promote legal platforms, potentially driving players into the arms of the unregulated black market.
Operators stress that a total advertising ban would render legal platforms invisible and inadvertently strengthen illegal operators who do not follow any rules.
The Ongoing Challenge of the Black Market
Illegal gambling continues to be a significant issue in the Netherlands, as the regulated market has yet to achieve optimal player channeling rates. Despite these challenges, the national regulator, Kansspelautoriteit (KSA), remains vigilant and active.
Recently, the KSA imposed substantial fines on two companies engaging in unlicensed gambling operations. One company received a $2 million penalty, while Novatech was hit with a record $28.9 million fine. The head of the regulator stated that the fines, particularly for Novatech, could have been even steeper.
