KSA Fines Vave.com $3.6 Million for Unlicensed Gambling Operations in the Netherlands

Introduction

The Dutch Gaming Authority, known as Kansspelautoriteit (KSA), has imposed a significant fine on a gambling operator based in Costa Rica for conducting unauthorized gambling activities. The authority reminded the public that only companies holding a Dutch gambling license are permitted to offer services within the Netherlands.

Vave.com Targets Dutch Players Without Authorization

The KSA announced it has fined Chestoption Sociedad de Responsibilidad Limitada, the company behind Vave.com, a total of 83,082,000 (approximately $3.57 million). This penalty came after it was discovered that Vave.com was accessible to users in the Netherlands, despite lacking any official Dutch licensing.

Investigations revealed that the operator’s gambling services were presented in Dutch, indicating an intentional focus on Dutch customers. Moreover, no safeguards were in place to restrict access from within the country.

The regulator also found several violations including the absence of age verification procedures, the presence of autoplay features—which are banned in the Dutch market—and acceptance of cryptocurrencies for betting, which the local regulations prohibit.

It is also important to note that Vave.com has previously been penalized in the Netherlands for similar breaches.

KSA Addresses Self-Exclusion Violations by Betnation’s Parent Company

Separately, the KSA has issued a formal warning to Smart Gaming, the parent company of Betnation, due to inadequate enforcement of self-exclusion policies. Some players who had opted to exclude themselves from gambling were still able to participate because the operator failed to properly verify their status.

Despite the seriousness of this issue, the regulator recognized Betnation’s proactive approach in reporting the problem and taking swift corrective measures. Consequently, the company received a reprimand rather than a more severe penalty.

Ongoing Regulatory Developments in the Dutch Gambling Market

The Netherlands, known for having one of the strictest gambling regulatory frameworks in Europe, is considering additional measures to tighten controls. Newly proposed rules by Justice and Security State Secretary Claudia van Bruggen aim to ban online gambling advertisements, introduce affordability checks, enhance self-exclusion mechanisms, and empower authorities to block unlicensed operators from reaching Dutch players.
