Husband Misuses Wife’s Care Funds for Gambling at Casinos

Background of the Case

A police officer in Alabama, Jackie Tucker, became incapacitated after being shot while on duty. Her husband, Sgt. Aaron Tucker of the Prichard Police Department, was entrusted as the conservator of her finances. However, investigations revealed that he misappropriated substantial funds intended for her care.

Misuse of Funds and Incident Details

Jackie Tucker was injured in 2016 during a domestic violence response when an assailant opened fire, leaving her seriously wounded and incapacitated. Over the years between 2017 and 2021, her financial conservator husband managed $554,305 meant for her care. Instead of properly using the money, most of it was spent by June 2022, with significant amounts gambled away at casinos in Mississippi.

Judge’s Findings and Actions

Mobile County Probate Judge Mark Erwin determined that the husband failed to use the funds appropriately. The judge highlighted that a $97,000 Mercedes Sprinter van, bought allegedly for injury-related transportation, lacked any handicap accessibility features. Additionally, the husband’s total expenditures from the wife’s funds amounted to $553,957.09, much of which was spent on gambling.

Consequences and Restitution

Following the findings, the court removed Sgt. Aaron Tucker as the conservator of his wife’s estate and finances. The judge also ordered Hartford Insurance, the provider of the fiduciary bond backing the husband’s conservatorship, to pay Jackie Tucker $300,000. This amount may be reclaimed from the husband by the insurance company in due course.
