Finnish Influencer Fined for Advertising Unlicensed Gambling

Finnish authorities have imposed a fine on an online influencer who promoted gambling websites not licensed to operate in Finland. Currently, Finland’s gambling industry is regulated under a monopoly system, where only one state-sanctioned operator is permitted to offer gambling services to the public.

Details of the Violation by Pottukoira

The North Savo District Court recently found Jouko Kärkkäinen, better known as “pottukoira,” guilty of breaching Finland’s gambling laws. The court’s findings revealed that between May 2023 and February 2024, he used his social media channels, including Kick and Instagram, to advertise illegal gambling platforms to Finnish users.

He promoted enticing casino bonuses and free spin offers, encouraging Finnish players to engage with these unauthorized operators. Despite pottukoira’s claim that his content was intended purely for entertainment and not aimed at Finnish customers, evidence showed otherwise. His official website contained affiliate links directing users to these unlicensed gambling services, undermining his defense.

Legal Consequences for the Streamer

Under the provisions of Finland’s Lotteries Act, pottukoira was sentenced to pay a fine of EUR 2,480 (approximately $2,840), payable within 80 days. In addition, he must pay an EUR 80 ($92) victim surcharge. The judge emphasized that the promotional activity constituted a significant violation even if the influencer did not personally profit from it, concluding that the intent behind his actions was commercial in nature.

The influencer has the option to appeal the judgment by July 20.

Finland’s Move Towards Gambling Market Liberalization

Amid ongoing regulatory changes, Finland is preparing to transition from its traditional gambling monopoly to a more open market that welcomes multiple operators. This shift aligns the country with many other European nations embracing a liberalized gaming industry.

The National Police Board has disclosed that over 50 companies have applied for licenses to operate in Finland’s forthcoming commercial online gambling sector, signaling strong market interest. This development positions Finland to become one of the prominent gaming markets in Europe.
