New Legislation to Address Gambling Elements in Gaming

Thailand is progressing rapidly towards legalized casinos, but alongside this, lawmakers are pushing to regulate gambling-like features found in other types of games. This development aims to control game mechanics such as loot boxes that resemble gambling and are especially popular in the video gaming industry.

Introducing the Promotion of the Game Industry Act

The Digital Economy Promotion Agency (Depa) in Thailand has introduced the Promotion of the Game Industry Act, a legislative framework designed to oversee and regulate games that include elements akin to gambling. The goal is to establish clear guidelines to protect consumers and increase transparency in the gaming sector.

Under this legislation, games that incorporate features such as prize draws, loot boxes, or systems where points can be redeemed will be subject to specific regulations. These mechanisms have been labeled as “hidden gambling” due to the risks they pose, particularly to younger players.

To ensure enforcement and oversight, three committees will be formed: Registration, Regulatory and Inspection, and Game Industry Promotion committees. These bodies will manage compliance and foster a responsible gaming environment.

Focus on Sustainable Market Development

The proposed framework has already received approval from key governmental bodies including the revolving fund committee of the Comptroller General’s Department and the National Broadcasting and Telecommunications Commission. The next step involves a review by the Cabinet before the bill is presented to Parliament.

According to Nuttapon Nimmanphatcharin, the CEO and president of Depa, the objective is to create a fair and sustainable market that protects consumers without imposing undue censorship. The focus is on eliminating loopholes while still encouraging developers to innovate creatively.

This framework is seen by some as a way to boost local game developers’ prospects while establishing a controlled yet attractive market for international businesses. It aims to strike a balance that supports Thailand’s ambitions as it prepares to become a leader in the gaming industry within the ASEAN region.

Looking Ahead: The Future of Gaming and Casinos in Thailand

If enacted, this legislation will make Thailand the first country in ASEAN to institute a dedicated legal framework specifically for the gaming industry. Meanwhile, discussions continue regarding the legalization and regulation of casino resorts, reflecting the country’s evolving stance on gambling.
