Agency Files Lawsuit Against Horseplay Over Trade Secret Theft and Unpaid Compensation

Background of the Lawsuit

RWV LLC, a marketing agency specializing in mobile gaming, has initiated legal action against the casino operator Horseplay. The dispute centers around allegations that Horseplay improperly used RWV’s confidential information to gain a competitive advantage, securing a lucrative partnership without providing the agency any financial compensation.

Details of the Partnership and Dispute

The lawsuit, filed on September 18, claims Horseplay initially agreed to a partnership with RWV but abruptly terminated their agreement after only a few weeks. Despite ending the collaboration, Horseplay reportedly leveraged RWV’s extensive industry connections to finalize a significant deal with Jason “Mr Hand Pay” Boehlke, a well-known content creator in the gaming community.

RWV contends that it was instrumental in facilitating this deal through its network and marketing expertise. Robert Venech, the owner of RWV, is said to have strong personal ties to Mr Hand Pay and contributed to his rise as a prominent online personality. To put this into perspective, Mr Hand Pay currently boasts over 1 million followers on YouTube.

Allegations of Unpaid Fees and Breach of Agreement

According to RWV, their contract included compensation terms that Horseplay has failed to honor. The agreement stated that RWV would receive $37.50 for each new player account generated through the partnership, plus a share of the net gaming revenue—15% in the first year and 10% in the second. Additionally, Horseplay was to pay a $5,000 fee for every influencer it onboarded through the agency.

RWV further alleges that after ending their contract, Horseplay communicated doubts about continuing negotiations with Mr Hand Pay, only to establish the partnership with him the very next day. Despite promises to uphold their financial commitments to RWV, the agency reports no payments have been made since the Horseplay-Mr Hand Pay deal was finalized in January 2025.

RWV’s Legal Claims and Compensation Sought

RWV is pursuing damages under the Defend Trade Secrets Act, asserting that Horseplay misappropriated proprietary information to secure a profitable alliance. The agency is seeking approximately $375,000 based on an estimated 10,000 new player accounts that resulted from the influencer partnership, along with an additional $135,000 reflecting a share of Horseplay’s related net gaming revenue.

The complaint also points to a pattern of non-payment by Horseplay to other service providers, including agencies and recruiters, indicating a broader issue with honoring contractual obligations.
