Ryan Pettway submitted the legal complaint on December 26 in the civil court of Clark County. The lawsuit names Boyd Gaming Corporation, which operates the Main Street Station hotel and casino, as well as Union Pacific Railroad Corporation. Pettway claims these entities failed to maintain the fence behind the casino, even though they knew the gap was regularly used by pedestrians crossing the tracks.

Circumstances of the Accident

According to the lawsuit, Pettway and others used the damaged fence to cross the railway on December 27, 2023, when he was struck by a freight train. The collision resulted in severe injuries requiring the amputation of his right leg and left foot. His medical treatment is expected to continue with multiple major surgeries and long-term care ahead.

Allegations of Negligence

Pettway asserts that both the casino operator and the railroad company were aware of the deteriorated fence and the frequent foot traffic in the area, which included evidence of homeless encampments beyond the barrier. This should have prompted immediate repairs to prevent accidents.

Ongoing Safety Concerns

Because no actions were taken to fix the fence, the area remained hazardous, contributing to the injury sustained by Pettway. The lawsuit seeks compensation exceeding $75,000 for medical expenses, punitive damages, and other losses related to the incident and its lasting effects on his life.

Union Pacific Railroad emphasized their commitment to community safety, advising the public to only use designated railroad crossings, avoid walking near tracks, and to always expect trains, which can approach from either direction at any time.
