Nevada Gaming Control Board Targets Kalshi with Injunction

The Nevada Gaming Control Board (NGCB) has initiated efforts to legally restrict Kalshi, a prediction markets platform, accusing it of unlawfully offering sports betting services through its platform.

NGCB Pursues Legal Action in State Court

The regulators have classified Kalshi’s operations as sports wagering and are working to halt them. Kalshi has actively challenged these regulatory measures. Recently, the NGCB shifted its legal strategy to state courts, believing state judges will more strictly enforce Nevada’s gaming laws compared to federal courts.

A Nevada court recently issued a temporary order requiring Kalshi to pause its activities while the case is being resolved. The outcome of an upcoming court decision remains uncertain. Other states have also begun re-filing similar cases in state jurisdictions. Industry experts suggest that if Kalshi continues to face unfavorable decisions, it might appeal all the way to the US Supreme Court.

Supporters of traditional gambling regulation, such as the American Gaming Association, argue that prediction market platforms pose risks due to inadequate safeguards against underage gambling and limited resources for problem gambling prevention. Kalshi and similar platforms contend they operate under the federal Commodity Futures Trading Commission’s oversight, which permits them to function across all states without adhering to individual state gaming laws.

Kalshi Founder Advocates for the Platform

Users and the company’s founder, Richard Lee, await the legal ruling to understand how the platform could proceed if forced to shut down. Lee, who also wagers on NFL games using standard sportsbooks, prefers Kalshi’s prediction market model, describing it as a healthier and fairer system.

According to Lee, traditional sportsbooks tend to exclude consistent winners, while Kalshi simply collects a fee on each trade, resulting in a fairer experience. Since transitioning to Kalshi, Lee reports earning a six-figure income from the platform.

Lee expresses confidence in the current federal regulatory framework overseeing prediction markets. He likens Kalshi to disruptive companies like Uber, which transformed traditional industries by challenging established norms.

Nonetheless, Lee acknowledges state concerns, noting that unlike conventional sportsbooks, prediction markets like Kalshi do not contribute gaming taxes to state governments, causing frustration among regulators.

Nevada is not alone in its legal dispute with Kalshi; several other states have filed lawsuits against the company. Washington is among the latest states to accuse Kalshi of engaging in illegal gambling activities.
