A devastating accident unfolded near Dotty’s casino in Las Vegas when a driver under the influence crashed into a homeless encampment, resulting in a fatality.
Details of the Crash
The incident took place on the evening of Friday, December 19, around 7:20 PM. The driver, 24-year-old Elijah Brown, was operating a 2007 Honda Accord along Warm Springs Road in southeastern Las Vegas.
According to police reports, Brown initially struck the center median before veering across several eastbound lanes. Approximately 1,000 feet later, his vehicle left the roadway and collided with a group of tents housing homeless individuals.
Tragically, Nicholas Sunday, a 61-year-old resident of the encampment, was struck and pinned beneath the vehicle. Emergency responders arrived promptly and pronounced him dead at the scene.
Investigation and Evidence Collection
Following the crash, authorities took Brown’s statement while he was receiving treatment for minor injuries. Brown suggested his loss of control might have been caused by a brake failure.
However, officers discovered Brown possessed an electronic marijuana device and a pill bottle, raising concerns about substance use. Toxicology reports revealed his blood alcohol concentration was 0.144, significantly higher than Nevada’s legal limit of 0.08.
Given the fatal nature of the incident and suspicion of impairment, police opted for a blood test over the routine breathalyzer. This procedure involves obtaining a warrant and having a medical professional draw blood, providing stronger evidence for legal proceedings.
Legal Proceedings and Consequences
Brown was brought before a judge on December 20, where bail was set at $100,000. His preliminary hearing is scheduled for January 6, and he remains in custody until then.
As for Dotty’s casino, no legal actions have been filed against the establishment, as Nevada law does not hold the casino responsible for the actions of its patrons after they leave the premises.
