Kansas Advances Efforts to Prohibit Smoking in Casinos

For years, casinos in the United States have been allowed a unique exception to the nationwide ban on smoking in indoor public spaces. This exemption has permitted gamblers to smoke while playing, despite the negative health effects on staff and other patrons.

Legislation Targets Smoke-Free Casino Environments

The topic of banning smoking inside casinos has been highly contested. Many casino operators have hesitated to act out of concern that customers might stop visiting if smoking were prohibited. However, some casinos that have already implemented smoke-free policies have not experienced significant drops in revenue.

In Kansas, momentum is growing to adopt similar measures on a wider scale. House Bill 2252 proposes amending the Kansas Indoor Clean Air Act to ban smoking in casinos completely. The bill also targets the use of electronic cigarettes and marijuana within these venues.

Health Risks and Nationwide Efforts to End Smoking Exemptions

Secondhand smoke remains a serious public health concern in the U.S. Advocates argue there are no valid economic or health reasons to allow smoking in casinos, even though smoking areas have shrunk significantly. Efforts to eliminate indoor smoking exemptions in casinos are not unique to Kansas; New Jersey is also actively challenging these allowances.

In New Jersey, casino employees are pushing for a legal ruling to confirm their right to a smoke-free workplace, appealing to the state Supreme Court to end the indoor smoking exception in Atlantic City casinos.

Challenges and Mixed Results in Smoking Ban Legislation

Despite growing support, some legislative attempts have failed. For example, a similar bill in Iowa did not pass. The debate has involved key lawmakers from various states, though progress has often been slow. Some opponents, like Senator Tony Bisignano, have resisted immediate bans but suggested that smoking inside casinos could be phased out in the near future.
