This decision supports Massachusetts Attorney General Andrea Campbell’s efforts to prevent Kalshi from offering sports betting contracts within the state.

The ruling by Judge Richard G. Stearns of the US District Court for Massachusetts ends Kalshi’s bid to change the legal venue to federal court. The case will now proceed in Suffolk County Superior Court, where state gambling regulations will likely dominate the proceedings. Attorney General Campbell initiated the lawsuit in September, arguing that Kalshi’s platform allows users to trade on the outcomes of sports events, which constitutes illegal gambling under Massachusetts law. Kalshi contends that its operations are governed by the Commodity Exchange Act (CEA), placing them under the jurisdiction of the Commodity Futures Trading Commission (CFTC), which it believes should override any state regulation.
