Iowa Moves to Strengthen Regulation of Unlicensed Gaming

Iowa legislators have recently proposed new bills aimed at tightening oversight on the gaming industry within the state. The House Study Bill 586 along with the Senate Study Bill 3040 would empower local regulators with greater authority to combat unauthorized gaming activities.

Enhanced Enforcement Powers Granted to the Iowa Racing and Gaming Commission

The House State Government Committee has put forward HSB 586, which complements Senate Study Bill 3040 introduced earlier this month. These bills would grant the Iowa Racing and Gaming Commission (IRGC) expanded capabilities, including the ability to take civil enforcement actions against operators running unlicensed gaming ventures.

This legislative move signals a stronger stance towards regulating the expanding sweepstakes market that has recently come under close examination. Although sweepstakes companies assert their products, often involving dual-currency systems, do not fall under gambling laws, they have faced increasing regulatory and industry pressure nationwide.

Several states have responded by enacting stricter laws targeting unlicensed gaming activities, with some outright banning sweepstakes offerings.

Direct Action Measures to Combat Illegal Gaming

If these bills pass, the IRGC will be authorized to directly address illegal and gray-market gaming operations, including real-money and dual-currency games of chance. The commission could issue cease-and-desist orders and pursue legal injunctions, reducing dependence on warnings or actions by other regulatory bodies.

This development adds further challenges for the sweepstakes sector, which already faces numerous lawsuits and regulatory crackdowns.

Nationwide Efforts to Regulate Sweepstakes and Illegal Gambling

Beyond Iowa, multiple states are considering or have enacted similar measures to curb unauthorized gambling. For instance, Indiana is reviewing proposed legislation intended to ban sweepstakes casinos and prohibit online lottery ticket sales.

Similarly, Maryland lawmakers continue to pursue stricter regulations through House Bill 295 and Senate Bill 112, aiming to close loopholes exploited by sweepstakes operators. These efforts follow previous unsuccessful attempts to regulate this area in 2025.
