In the early hours of August 30, 2025, law enforcement officers responded to reports of sexual activity occurring in a public space within the Peppermill Casino. Upon arrival, they found Ching and an unidentified woman in the act. As a result, Ching was arrested and charged with two misdemeanors related to lewd conduct in a public place. The woman stated that the encounter was consensual and was also taken into custody, although no formal charges against her have been confirmed.

Judge Scott Pearson sentenced him to 180 days in jail; however, the term was suspended.
