Judge’s Decision Forces Evolution to Provide Important Documents
The legal confrontation between the live casino operator Evolution and the investigative firm Black Cube in New Jersey has intensified, with both parties marking some legal victories as the trial date approaches. This dispute has drawn significant attention within the online gambling community for several months, revolving around allegations that a damaging report aimed at undermining Evolution’s reputation among regulators was commissioned by an undisclosed party.
Recently, Judge John C. Porto issued rulings that impacted both sides, ensuring that the already complex discovery phase will continue. A key outcome was a court order compelling Evolution to surrender additional documents related to a regulatory investigation central to the case. Specifically, Evolution must hand over the Spectrum Gaming report previously mentioned, along with communications and documents involving Spectrum and relevant New Jersey gaming authorities. This includes records of meetings, transcripts of conversations, and related materials.
Evolution protested that these additional document demands were unnecessary and appeared intended to prolong the litigation. Conversely, Black Cube maintained that their requests were narrowly focused and critical to building their defense, especially given prior court statements identifying Playtech as the source behind the initial report.
No Resolution Yet as Case Continues
In a partial victory, Evolution secured an order requiring Avi Yanus, a Black Cube director, to complete his deposition, which remains unfinished. However, the court denied Evolution’s plea to expedite a hearing under New Jersey’s anti-SLAPP legislation, on grounds that issues regarding evidence and privacy must be resolved first.
Following the court’s decisions, Black Cube expressed satisfaction and eagerness to review the newly disclosed materials, suggesting that this evidence will reinforce their prior allegations. They assert that unauthorized access to Evolution’s games occurred in locations where such activity should not have been possible.
Evolution, on the other hand, has consistently rejected these accusations. The company claims to have conducted thorough internal audits and cooperated fully with regulators, emphasizing its confidence in its compliance framework and denying any wrongdoing.
This ongoing dispute has ramifications within the gaming technology sector, especially following revelations linking Playtech to commissioning the contentious report. As discovery proceeds without indication of settlement discussions, the contentious legal battle is expected to escalate as it moves closer to a full trial.
