CLEVELAND -- Child support payments are a big reality former couples must deal with every month.
The big question is, are your paying too much or are you receiving too little?
NewsChannel5's Joe Pagonakis reported that's a question that has more and more divorcees heading back to court.
Thousands of marriages end in divorce in Cuyahoga County Court every year. In many cases, children are involved when mom and dad decide to give back their wedding rings for good.
As the years go by, how can you be sure you are receiving all the money you deserve, or if you're paying too much?
"People need to understand that this is not a fixed amount, child support is not fixed forever," said divorce attorney Alice Rickel.
A legal document filed with the courts can be the difference between paying too much or getting too little.
Domestic Relations Judge Timothy Flanagan said you can use it in one of two ways.
"You can go to the Child Support Enforcement Agency and ask that they conduct an administrative review. That then can be recalculated and a determination is made. And if anyone objects to that then they can come back to court," Flanagan said.
Pagonakis reported that you should consider reviewing your child support if there has been a 10 percent change in incomes, day-care costs, or medical expenses and benefits.
"Some of my clients had their health care costs climb by 17 to 18 percent. That would increase the amount of child support significantly," Rickel said.
A number of Web sites on the Internet can help, too. Keep in mind these sites are for reference only. The child support enforcement agency will review your case at no cost. But keep in mind if you take your ex-spouse to court and win, you could lose the remaining goodwill of your former spouse and children.
"They know they'll get a reduction, but keep in mind it could tip the apple cart in terms of your relationship with your ex-spouse, so there is a price to pay," Rickel said.
Spousal support payments or alimony are not as easily reviewed or modified.
