Fmr OSU band director's lawyers seek to withdraw

Ohio State University's fired marching band director can no longer afford the high-powered legal team that has been helping him fight for reinstatement.

In court filings Wednesday, members of a team that included a former assistant U.S. attorney and a former Ohio attorney general asked to withdraw as counsel for Jonathan Waters. They told a federal judge that Waters can't "substantially fulfill his financial obligations."

Attorney David Axelrod says making the request was difficult.

It could spell the end of Waters' efforts to fight his July 2014 termination. Waters says he's saddened that finances are impeding his efforts, and he's weighing his options.

Ohio State alleged Waters ignored a "sexualized culture" inside the celebrated band. Waters denied that.

Waters' suit alleges gender discrimination and seeks $1 million in damages.
