Ohio arson suspect wants death penalty thrown out

TOLEDO, Ohio - Attorneys for a Toledo man charged with aggravated murder for allegedly setting a fire that killed two firefighters are asking a judge to throw out the possibility the death penalty.

In court filings, attorneys for Ray Abou-Arab argue that prosecutors don't have evidence to prove that he purposely meant to kill anyone in the Jan. 26 apartment house blaze that left the two firefighters dead.

The (Toledo) Blade reports that the motion was included in a recent flurry of filings by defense attorneys.

The judge was issued a gag order in the case. Abou-Arab is jailed on charges that also include aggravated arson and tampering with evidence.

Authorities say he set fire to property he owned.
