The brother of Kate Allen, who was shot and killed by her estranged husband last year, is suing Cracker Barrel.
CLEVELAND - Funeral arrangements for 10-year-old Kayla Allen, who died Tuesday after being critically injured in the Brooklyn Cracker Barrel shooting April 12 by her father that killed her mother and her sister, have been set for Monday.

Kayla died Tuesday surrounded by family at her aunt Michelle and uncle Carl Jindra's home. She had been in hospice care since May 11.
On Kayla's memorial Facebook page, a family member wrote this when Kayla passed away:
Revelation 21:4 "He will wipe away every tear from their eyes, and death shall be no more, neither shall there be mourning, nor crying, nor pain anymore, for the former things have passed away."
A pair of fundraisers are still scheduled. One will be held at Barbarino's Restaurant in Columbia Station from 7 p.m. to 11 p.m. on Thursday.
