Prosecutors asking murder charges be dropped in 'East Cleveland Three' new trial case

Cuyahoga County prosecutors are asking a judge to dismiss all charges against three East Cleveland men accused of a 1995 murder.

Collectively known as the 'East Cleveland Three,' a new trial was ordered in March 2015 when new evidence surfaced in the case.

In court Tuesday, prosecutors sought to dismiss the case saying "it would be difficult to evaluate and reconstruct a case twenty years after an event."

Even so, they also asked to reserve the right to re-file similar charges if evidence warranted.

Defendants Derrick Wheat, Laurese Glover and Eugene Johnson remain free on bond.

Cuyahoga County Common Pleas Judge Nancy Margaret Russo has scheduled a new trial in the case and will rule on the motion to dismiss on August 15, 2016.
