Man who raped woman, shot son during carjacking in 2006 sentenced

A man accused of raping a woman and shooting her son after a carjacking in 2006 was sentenced to a maximum 36 consecutive years in prison. 

Javier Colon, 40, was sentenced Tuesday in Cuyahoga County Court by Judge Nancy Russo.

The victims, a woman and her 18-year-old son, spoke in court for the first time asking for the maximum penalty.  

In 2006, Colon carjacked the mother and her son in the Warehouse District. Police say he forced the woman to drive to a remote location and then forced her son into the trunk of the car. He then sexually assaulted her. 

The son was able to get out of the trunk through the hatch in the back seat but Colon struck him in the head several times with a gun. 

The man and Colon then began to struggle. Colon shot the son in the chest and fled. The son survived the shooting.

"I’m angry and full of hate because he shot my son could have killed him," the victim said in court. "He touched me in ways I would not have let him." 

Colon was not identified as the suspect until 2016 when DNA that he left on the trunk was matched to his DNA in a national database. Touch DNA matching Colon was also found on the waistband of the victim's pants. 

At that time, he was taken into custody. 

On Jan. 25, Colon pleaded guilty to rape, kidnapping and attempted murder.  

"The judge agreed that the maximum was appropriate here and we are extremely grateful that she agreed," said Assistant Prosecutor Mary Weston.
