Gazebo where Tamir Rice was shot will come down

Nearly a year and a half after Tamir Rice was shot and killed by Cleveland police near the Cudell Rec Center gazebo, city officials said they're going to take the gazebo down.

The 12-year-old was shot after  someone sitting in the gazebo called 911 to say someone was pointing a gun at people.

The gun turned out to be fake.

"It's not a part of the written settlement,” said Subodh Chandra, the attorney for Tamir's mother and family.

Chandra said taking down the gazebo is not officially apart of the $6 million settlement with the city of Cleveland.

"But there is an informal understanding between Tamir’s mother, Samaria Rice and the city of Cleveland that the gazebo will come down," Chandra said.

Chandra said the gazebo is a constant and tragic reminder of what happened there in November of 2014.

"It's a place of terrible memories and so Samaria Rice is really gratified that the city is moving forward expeditiously to take it down," Chandra said

Anthony Mayo jogs past the gazebo everyday.

"I think if the family agrees to take it down that's fine, but it does serve memory for Tamir Rice," Mayo told us.

"I think if they want it taken down that's fine, but maybe a memorial or something like that should go up." Mayo said.

"Miss Rice and the city also have an understanding that a donation of a modest memorial for Tamir is appropriate, so we anticipate that will be happening in the coming weeks," Chandra said.

Chandra said he expects the gazebo will be taken down Monday.
