The estate of a 22-year-old man who was found dead in a landfill after going missing at a concert at Progressive Field in 2014 alleges that the Cleveland Indians and Live Nation were negligent the night he went into a trash chute.
Cory Barron of Fremont disappeared during a Jason Aldean concert on July 18, 2014.
Now, in wrongful death suit, his family is saying the organizations created "the unsafe and dangerous conditions at the facility by failing to secure a two-story open chute that was open, unsafe and dangerous."
That night, according to a suit, Barron entered a room in the upper deck of Progressive Field that had a trash chute, which led directly to a dumpster located 50-feet below, in the lower level.
Barron's family alleges that the door to the trash chute was not properly locked and secured during the concert due to a broken lock on the door.
Barron's body was discovered four days later by landfill workers at the Oberlin Elyria Road facility.
The Barron family is asking for damages in excess of $25,000 for five counts including: negligence, negligent security, failure to secure and protect a patron who is served intoxicating liquors, wrongful death and survivorship against all defendants.
