CLEVELAND - Cuyahoga County Executive Ed Fitzgerald is seeking legal action to prevent the closure of the air traffic control tower at the Cuyahoga County Airport in Highland Heights.
Fitzgerald, along with county Director of Law Majeed Makhlouf, said the county will file a request with the Federal Aviation Administration to review their decision to close the tower. Fitzgerald said they will also file a stay tomorrow with the U.S. Court of Appeals for the District of Columbia Circuit Court in Washington, D.C.
If the FAA does not reverse it's decision upon further review or does not review their ruling at all, the County is hopeful the court of appeals will halt all actions against the closing until further review can be done.
Fitzgerald said the FAA did not conduct appropriate safety reviews, measure environmental impact or maintain a commitment to keeping the control tower open.
Makhlouf said the county is unclear about the exact date of the closing which could be as soon as April 7 or as late as May 5.
