CLEVELAND - A federal appeals court has ruled that prosecutors in Cleveland can't pursue another trial against a man who was released from Ohio's death row.
Prosecutors said they're considering appealing Monday's decision in the case of Joe D'Ambrosio.
He spent more than 21 years behind bars in the 1988 killing of a man in Cleveland until a judge let him go in 2009.
His release came after a federal judge ruled that prosecutors failed to provide evidence that could have exonerated him.
A defense attorney says he hopes the latest ruling, issued Monday by the 6th U.S. Circuit Court of Appeals in Cincinnati, will mark the end of D'Ambrosio's prosecution.
