Prosecutors Say Items Taken From Man's Home Still Under Investigation

The owner of a home that was searched last week in the Gina DeJesus case was in court Monday on unrelated charges.

Police searched the home and excavated the garage of 36-year-old Matthew Hurayt last Friday but found no evidence relating to the missing teen, who disappeared more than two years ago from a west side neighborhood.

Hurayt and another man were arrested Thursday night, but were released when police did not uncover any evidence at the West 50th Street home.

NewsChannel5 reported that Hurayt appeared in court about two hours later than scheduled after he was picked up by police for reasons unknown at this time.

Judge Stewart Friedman held off sentencing Hurayt on charges of minor theft, saying he wanted to focus on the more serious charges against him on assault and kidnapping.

Hurayt is now free on bond. In court, his attorney told the judge that Hurayt was falsely accused and threatened, and his rights were unfairly taken away.

Hurayt was held by Cleveland police for four days while investigators searched his home. Police received a tip that the remains of Gina could be buried on his property.

Hurayt's attorney asked questions about the search warrants used to search Hurayt's home, asking how they were obtained and what judge signed them. He called the investigation a "fairytale."

But the court and the Cuyahoga County prosecutors backed up the action of the Cleveland Police Department, saying that the search was not without purpose.

NewsChannel5's Joe Pagonakis reported that prosecutors would not be specific, but said that 19 items taken from Hurayt's home are still being investigated.

Hurayt's trial on felony charges in an unrelated assault case has been continued until Oct. 10.

The other man held in connection with Friday's search, 56-year-old John T. McDonough, has also been released.
