Jury Finds Man Not Guilty On Assault Charges

CLEVELAND -- The jury in the Daniel Hines attempted rape trial told a judge Tuesday that it is hung on three of the charges against the Cleveland man. Hines was charged with attempting to rape his 13-year-old cousin in 2003.The jury found Hines not guilty on four counts of assault stemming from prosecutors claims that he beat up his cousin's brother when he tried to intervene.But the jury was unable to reach a verdict on four charges of attempted rape, kidnapping, gross sexual imposition and disrupting public service.The jury deliberated for three hours on Friday and all day Monday without reaching a verdict. Jurors told the judge Monday that they were at an impasse on three charges, but the judge at that time asked them to continue deliberations.By midday Tuesday, the jurors told the judge that they were still deadlocked.Prosecutors plan to retry Hines on the four charges. Hines' defense attorneys are asking that his bond be reduced. He remains jailed on $100,000 cash bond.Hines was previously tried for the kidnapping and murder of 11-year-old Shakira Johnson in September 2003.
