Court To Rule If Brain-Dead Baby Can Die

Child Has Been On Life Support

The fate of a 5-month-old on life support will be decided in an appeals court today, NewsChannel5 reported.

The 9th Ohio District Court of Appeals will hear arguments on whether to keep baby Aiden Stein alive.

The parents of the child, Matthew Stein and Arica Heimlich, have until noon today to provide evidence to battle the courts and state-appointed guardian to keep their son on life support, despite his vegetative state.

Aiden's 21-year-old parents want him to remain on life support.

They are also defending themselves on criminal charges. Police said Aiden was violently shaken and now has irreversible brain damage.

Arica said the last time she saw her baby before he was placed on life support was when she left for work on March 15.

Matthew said the baby suddenly stopped breathing.

Since Aiden was put in the Akron Children's Hospital, a state-appointed guardian has been making the baby's health decisions.

The guardian said he agrees with the doctors that the baby will never fully recover.

If Aiden is taken off life support and judges side with the guardian, it could be days or weeks until the baby finally dies.

Doctors said even though his brain is damaged, his brain stem is still functional. The stem keeps the heart and lungs working.

So far, no charges have been filed against Aiden's father.
