Suspect In Tomato-Thrower Killing Charged With Murder

There's been an arrest in the shooting death of a man who was throwing tomatoes at vehicles from a Holmes County cornfield Sept. 1.

NewsChannel5 reported that Marion Weaver, 58, has been charged with murder in the case, according to the Holmes County sheriff's office. Weaver, a lifelong resident of the area, lived just 5 miles from the shooting site in a small community called Benton.

Steven Keim, 23, of Orrville, was shot by after pelting vehicles with tomatoes. That's a prank common in late summer in the Amish area of northeast Ohio.

He was hiding in the cornfield with about 10 others, ages 15 to 23, who told authorities they were throwing tomatoes and firing paintball guns at passing vehicles.

Investigators believe Weaver became irate and shot into the cornfield, striking Keim.

Officials seized weapons from Weaver's car, including one that appears to be the murder weapon. Investigators also found 12-gauge shotgun casings in the cornfield that tests show matched ones from his gun.

Weaver was arrested Tuesday morning at a local hospital without incident. He had apparently been suffering from an undisclosed ailment since the shooting.

Officials said tips and physical evidence helped them track down Weaver.

The suspect is being held in the Holmes County Jail on $250,000 bond.

The behavior of the shooter after the crime could be very important to the investigation, according to officials. Witnesses said that after he fired the deadly shots across the field, he drove back past the crime scene very calmly a couple of times before turning down a country road and then driving off.

Investigators said that brings up the question whether he ever intended to hit anybody and whether he ever knew that he had.
