Cutts Trial Blog Day 6: Bobby Cutts Jr. - 'I Didn't Mean To Hurt Her'

4:27pm Barr is asking Cutts about leaving Blake home alone and asked if he was concerned about Blake. Cutts said that at that time, Blake was not the top priority.

4:25pm Barr showed a picture of Jessie's body the way it was found in the park - decomposed. He asked if this is how Bobby left Jessie. He said yes.

4:21pm Barr is asking about how Cutts opened the bottle of bleach. Cutts showed him that he grabbed the handle and twisted the cap. Cutts then talked about being at the park. He said he pulled the body out of the truck and carried the body by the torso. He said he dragged the body into a clearing.

4:19pm Court is back in session. Bobby Cutts Jr. is still on the witness stand being questioned by Assistant Prosecutor, Dennis Barr.

3:56pm Court is now in a 15 minute recess.

3:51pm Cutts said when he left Jessie's house, his intentions were to return that day.

3:50pm Barr asked how Blake knows his mommy is wrapped in a rug. There was an objection and Barr withdrew the question.

3:46pm Cutts said he didn't roll Jessie in the comforter. He said he wrapped it around her and dragged her down the stairs and put her in the truck. Cutts then said that he never put hamburger buns on Blake's bed.

3:42pm Barr asked if Cutts called 911 after hitting Jessie. He said he did not.

3:30pm Cutts is confirming what he's already said about what happened in Jessie's bedroom.

3:27pm Barr is now asking about Cutts going to Jessie's home on the morning of the 14th.

3:25pm Barr showed Cutts training papers showing that Cutts was retrained in CPR in April, 2007.

3:21pm Cutts said while talking to Barr that child support was not an issue. Barr is asking him about the $2,800 in debt per month - not including child support. Barr asked if he was paying child support on his first daughter and he said that order was suspended and he was not paying.

3:18pm Cutts said that between the 16th and 22nd of June, Richard Mitchell was at his house a few times and set up the interview with the Canton Repository without his knowledge. Cutts also said that he listed Mitchell as a reference on two loan applications.

3:17pm Cutts said that he did have sexual relations with other people while he was still with Kelly (and not while they were separated).

3:15pm Barr asked if Cutts had a cold. He said no. Barr said, "Because I don't see any tears." He then asked if Cutts cried this much when he dumped Jessie's body in the woods. Cutts said he did cry.

3:13pm Cutts said that he never told anyone the truth until today. Mack is now finished questioning Cutts. Assistant Prosecutor, Dennis Barr, is now questioning Cutts.

3:10pm Cutts said he can't explain why it took so long to tell authorities where to find the body. He said that he eventually took authorities to the location. He couldn't remember exactly where it was but after searching, he saw the location and told them to stop. He said that he had no idea that Jessie's body would end up looking the way that it did. He said that one of the reasons that he wanted to show the body was to show that he didn't do it on purpose.

3:08pm Cutts said that at some point, he decided to lead authorities to the body. He said that during that meeting, he didn't think that anyone knew where the body was. He said that on Friday, June 22nd, after meeting with the FBI, he decided to show where the body was. He said because both families had been through so much, he had to end it. On Saturday, he and his attorney went to the FBI office and told them where the body was. He said he wanted them to find the body and for, "this all to be over."

3:06pm Cutts said that his mom went to talk to Jessie's mom and while she was there, Jessie's dad said he was going to kill Bobby. The State objected. There is now a sidebar.

3:04pm Cutts said that on Saturday, the 16th, the news media started showing up at his house and he started getting phone calls from a bunch of people. He said Myisha came over that day - Bobby's cousin Larry picked her up to bring her over. Cutts said she came by to see if he was okay.

3:02pm Cutts said that he told Weisburn that he picked up Myisha to watch Blake. He didn't tell him the rest of what happened because he didn't want Myisha to be in trouble.

3:00pm Cutts said he didn't tell anyone what happened but he couldn't explain what happened. He was afraid that nobody would believe him. He said that he then spoke to Sergeant Weisburn of the Stark County Sheriff's Department. Cutts said Weisburn was looking at him like he did something. Cutts said Weisburn interviewed him twice. The first time, at Jessie's house, he didn't tell him the truth. The second time, after the crime lab looked at his truck, the spoke again.

2:58pm Cutts said that when he got there, Jessie's mom and sister Audrey were there along with a Stark County Deputy and Blake. He said when he went inside, he was hoping to see Jessie and it would all be over. He went with the Deputy into the house and saw bleach all over the bedroom. He said he presumed that Blake was the one who put the bleach there.

2:57pm Cutts said before the end of his shift, Myisha called to ask if he was alright and he said he wasn't, that he needed to get his son. He said he left work early that day, about 7:45am on June 15th. He said he was heading to Jessie's house to pick up Blake. He said on the way there, he got a call from her (Jessie's) sister. She said, "Jessie's missing, hurry up, get here."

2:56pm Cutts said he went to coach basketball and then went to work at 10pm. His regular shift was 10pm - 8am.

2:54pm Cutts said that was the first time that he was at home. He said he was replaying the morning in his head. He said he was supposed to coach basketball later that day and also go to work. He said while he was home alone, he kept telling himself, "this isn't real." He said if he called Jessie, everything would be alright. He said he called her phone and left her a message and didn't remember what he said. He said he was hoping that when she answered, "this whole thing would be over" and it wasn't.

2:52pm Cutts said that he took Myisha home and went back to his house to start mulching with his daughter. She didn't want to mulch so he bought her a Sno Cone maker so that she would help him. He said they went back and started to mulch. He said Kelly came by around 3:30pm to pick up Brianna.

2:50am Cutts said that this was the only time in his 10 years as a parent that he wasn't thinking about being a parent. He said he went to football practice. After practice, he picked up his daughter, Brianna. He said he went back home where Myisha remained.

2:49pm Cutts said that while getting out of the shower, a bandage fell off his finger. The finger had been cut the previous day while doing yard work. He said its on the opposite hand from the one that Jessie bit. He also said he noticed scratches on his chest from where Jessie had grabbed him.

2:48pm Cutts said he stopped to pick up mulch because he remembered that he was supposed to mulch that day. Then he went home and got in the shower and washed and washed and washed and washed. He said that he was trying to wash everything away.

2:46pm Cutts said he said to himself, if he just went on with his normal day, it would all go away. He said that when he looked at the clock, it said 8:40am and he realized he was going to be late for football practice. He left the coach a message that he'd be late. He then called Stephanie Hawthorne, since her son's on his team. He said he wanted to let someone know he'd be late. He kept heading toward home with Myisha still in the truck.

2:44pm Cutts said when he went to turn around, he got out to see how much room he had and saw a pillow from Jessie's house still in the truck. He saw a dumpster and threw the pillow and a bag of trash that was in his truck into the dumpster. He said then he went back toward Canton.

2:42pm Cutts said Myisha told him she needed cigarettes. He said he kept saying, "This is not real, this cannot be happening, this is a bad dream." He said he saw a store next to a car wash and since there were bugs on his windshield and he had no washer fluid, he pulled in. He said while there, he started spraying off his truck and Myisha went in a store to get cigarettes. He said he sprayed the entire truck. He said Myisha got back in, he saw a sign for a highway and turned around.

2:41pm He said that when he got back in the truck, Jessie's phone fell out of his pocket. He said when he started driving, he decided to throw Jessie's phone out the window because he couldn't get it to work. He said it didn't make it out the window, but fell by Myisha and he asked her to throw it out and she did. He said it took a couple minutes to get out of the park.

2:39pm He said he was driving around for a half hour or so and didn't know where he was. He said he saw a dirt road and pulled on to the dirt road. He said it was a park but it didn't look like a park. He said he was driving around the road, just about to exit the park again and he stopped. He said he left Jessie at that location.

2:36pm After making the phone call, Cutts said he got off to turn around and go back 77 South to go back to Jessie's house. He said Myisha told him she needed to use the restroom. He said they stopped and after that, he was about to get back on the highway when he saw a State Trooper. He said he panicked and said that if he got pulled over with Jessie's body in the back, he wouldn't be able to explain it. He said that at the next exit, he got off and tried to get back to Canton using back roads.

2:33pm He said he told Myisha something bad happened. Cutts continues to cry as he tells Mack that he and Myisha continued up 77 North. He said that he looked at the clock and saw 7:10. He said that's the time that Jessie always yelled at him about. He said that was the time she had to be on the road for work. He said, at that time, he called Jessie's phone. He said he didn't know why he called her phone. He said he wasn't trying to conceal what had occurred.

2:31pm Cutts again said that he picked up Myisha so she could watch Blake. He then said he got back on the road, on 77 North, toward Jessie's. He said he was almost at the exit and started asking himself how he was going to explain what happened. Instead of exiting, he kept driving.

2:28pm Cutts said that he got to Myisha's house and he asked her to go with him right then. He said she went in to get something and then got in the truck. He said he was there for about 5 minutes.

2:25pm Cutts said that he was wondering how he was going to explain what had just happened. He said he just went to get his son, he didn't want to hurt anyone. He said he didn't think Blake would be there alone very long. He then got on the highway and went to Myisha's house - about 15 minutes away.

2:23pm Cutts said he put the comforter around Jessie and put her in the bed of his truck. He said he then went back into the home. He said in case Blake woke up before he got back, he went in and closed the garage door and went out the back door so he could get back in when he got back. He said he didn't remember putting Jessie's phone in his pocket. He also said that there was a lot of bleach left in the bottle when he left. He said that he then left and he was going to get Myisha to watch Blake.

2:22pm Cutts was asked why he didn't call 911. He said he tried but couldn't use Jessie's phone. He said that he knew that she was dead at that time. He said he couldn't believe it was happening. He said he never tried to hurt anyone.

2:21pm Cutts then said since Blake was sleeping, he wanted to let him sleep. So he decided to get Jessie and take her with him.

2:19pm Cutts said that he decided to leave. He said he didn't think that Blake was awake. He went down the stairs and said to himself that he couldn't leave Blake to find his mom the way she was. He said he went into Blake's room to see him sleeping. He said he went back out of the room, pacing, trying to figure out what to do. He said that's when he thought about the idea of getting Myisha.

2:17pm Cutts said he didn't mean to hurt her. He said he stood up and collapsed onto her bed. He was wondering how he was going to explain this. He said he had no idea when he went to pick up his son that any of this was going to happen. He's crying harder now. Mack is asking him if he went over with intent--he said no. Mack asked if it was about child support and Cutts said he didn't care about child support.

2:16pm Cutts said when he stood up, he knocked the bleach over. He said he then looked for Jessie's phone. He grabbed the phone and was going to call for help but wasn't able to because he couldn't turn the phone on.

2:14pm Cutts said he couldn't find a pulse and couldn't find one but thought maybe she had been knocked out. He said he remembered being revived with ammonia when playing football and went looking for alcohol. He said he then grabbed the bleach from the closet and tried to put it under Jessie's nose. He said it was hard to do do he poured some in a cap and put it under her nose and it didn't work. Cutts continues to cry during all of this testimony.

2:10pm Mack asked if Cutts had ever tried CPR on a person. Cutts said that he had only done it in training, on dummies. He said he did the training every couple of years. With Jessie, he said he tried to remember the steps that he was supposed to do. He said he tilted her head back. He then tried the breaths first, listened and didn't hear anything. He said he then started chest compressions. He said he did 10 and checked for breath again and did 10 more.

2:08pm Cutts said he then shook her and asked her again. She didn't respond again. He said he then tried CPR and checked for a pulse in her neck.

2:06pm Cutts said that he didn't see Jessie fall because he was walking toward the door. When he heard her fall, he turned around. He said she was laying on the floor. He went over to her and asked, "Are you alright?" He said she didn't respond.

2:01pm Cutts said Jessie fell pretty hard. He said she fell harder than he expected her to. There is now a sidebar. Cutts has removed his glasses and is holding a tissue over his eyes.

2:00pm Cutts said, through tears, that he just wanted to leave. He said he threw the elbow so she wouldn't grab him anymore. He said the elbow hit her in the throat area.

1:58pm Cutts said he thought Jessie was upset because he was rushing her more than she wanted to be rushed at that time. He said he stepped back and looked at his finger and told her that he was leaving. He said he tried to get around her again, she stepped in front of him again. He said he pulled his arm away, threw his elbow back and.... Bobby is now crying on the witness stand with his head in his hand.

1:57pm Cutts said Jessie then grabbed his arm and pushed him back. He said he could get her out of his way, he said he put his finger up his nose and then put it in her face. He said she then bit his finger. He said he didn't expect that. He expected her to move and then he could get around her.

1:55pm Cutts said he became fed up and tried to leave saying he could get Blake that weekend. He said Jessie then stepped in front of him and grabbed him by his shirt and said that he had to watch Blake. He said he pulled away from her and tried to get around her but she stepped in front of him again. He said he told her he was trying to leave and she was taking too much time and he could be back asleep.

1:53pm Cutts said Jessie told him that if he hadn't been out all night, he wouldn't have had to hurry her up. He didn't know it was an issue til this conversation. He again told her to hurry up.

1:52pm Cutts said he asked if she could get Blake ready so that he could go. He said she took her time to get up. He then said he'd help her get up. He said he helped her up off the ground. He said she was standing around getting her bearings and he asked her to hurry up.

1:51pm Cutts said when he got upstairs, he saw Jessie on the floor and he asked if she was having the baby. She said no, that she was tired.

1:50pm Cutts said that he did not have a bottle of water when he entered the home. He said he called Jessie's name and she responded. She said, "I'm up here."

1:49pm Cutts said he got to Jessie's at about 5:45am on the 14th and parked in the driveway. He said he went in through the garage. He said the door was always up when he was supposed to pick up Blake.

1:48pm Cutts said that the clocks in his house are 10 minutes fast so he really woke up at 5:20am. He went to Jessie's house which is 10 minutes away.

1:47pm Cutts said that he went to bed when he got home after setting his alarm clock for 5:30am. He said that the arrangement was to pick up Blake before 6am.

1:44pm Cutts said that he and Stephanie both fell asleep at her place. He said she ended up waking him up at he decided to go home. He said that if he stayed at Hawthorne's he may not wake up in time to get Blake. He said he left Stephanie's around 2am and it takes 10 minutes to get to his house from hers. He said that on his way home, Hawthorne called him to joke around that he was the one who decided to leave this time - a running joke between the two. He said he got home about 15 minutes after leaving Hawthorne's. The last time he had spoken to Jessie was around 8pm the night before.

1:43pm Cutts said that he had a great time at Champs with his friends. He said there were no problems with Jessie while he was at Champs. He said he left around 1am and was going to Stephanie Hawthorne's place. He said he called her on the way to say he was coming. He said it was a 5 minute drive.

1:42pm Cutts said that at that time he was still separated from his wife Kelly at that time and he was having an intimate relationship with Hawthorne.

1:41pm Cutts said that other than Moses and Ladson, other people they knew showed up at Champs. He said that Denise Haidet was one of the people who showed up. He said that he had previously had a sexual relationship with her. He said that he called Mike McClusky while at Champs. He also spoke with Stephanie Hawthorne, Larry Davidson, Scott Paradis.

1:40pm Cutts said that after going inside, he ordered food and a Corona. He said he had 4 or 5 beers in the four hours that he was there.

1:38pm Bobby said he called Jessie after the 2nd game to tell her that he was going to Champs bar and that if he had anything to drink, he would wait until the next morning to get Blake. He said he then went to Champs and got there around 8:30-9:00pm. He said that Ladson and Will Moses were already there.

1:37pm Bobby said that he lost the softball game and so he watched the 2nd game with Will Moses and Andrew Morgan and a couple of other guys. James Ladson was playing in the 2nd game.

1:36pm Bobby said that he talked to Jessie as he arrived at the softball game. He said he told her that he'd more than likely come that night to pick up Blake but that he would call for sure after the game to let her know for sure. He said he'd probably pick up Blake around 10pm.

1:35pm Bobby said that on the morning on June 13th, he did some prep work to mulch his yard. He said he then went to the gym and worked out and then got a haircut. He said he then came home, got something to eat and went for a run. He said he had a softball game that night at 6:30pm.

1:33pm Bobby said that he asked Myisha Ferrell to watch Blake on Thursday the 14th since he realized that he had to go to football practice. He also testified that he gave her $100. He said that she had previously asked him to borrow money. He said he gave her the $100 and $20 of it was to watch Blake and he expected $80 to be paid back.

1:30pm Bobby said that the week of June 11, 2007, he had just started coaching football and was also coaching basketball and soccer. He said he was also working extra security jobs. He said that he decided that he could watch Blake on Wednesday, June 13th or on Thursday, June 14th. He said that he and Jessie had decided that on Monday the 11th.

1:29pm Bobby said that on that night, he went to her house and after 20 minutes, it turned out that Jessie didn't need to go to the hospital.

1:28pm Bobby said that on June 10, 2007, he received a text message from Jessie asking if he was working that night. She responded that she might need him to watch Blake in case she had to go to the hospital. In a subsequent phone call, she told him that she might be going into labor.

1:27pm Bobby said that in the eight months that he's been in jail, Richard Mitchell never visited him.

1:26pm Judge Brown sustained the objection.

1:24pm After Mack asked Cutts if he wondered why Mitchell would say that Bobby said, "I'm going to kill her and throw her in the woods," the State objected and there was a sidebar with the Judge.

1:21pm Bobby said that he never represented to anyone that he would ever cause harm to anyone. He said that Richard Mitchell's statement had no base behind it. He said he would never joke about killing someone and throwing them in the woods. He said that Richard Mitchell was not his best friend. They played golf, basketball and video games together.

1:19pm Defense Attorney, Fernando Mack, is questioning Cutts Jr. Bobby just said that in February, 2007, Kelly decided to leave him. He said that at that time, he wasn't fighting with Jessie - they had a relationship where she was Blake's mother and he was Blake's father. He said that he saw Blake at least once a week. He said that he had no physical confrontations with Jessie as a result of Kelly leaving him.

1:16pm Bobby said that in November, 2006 he and Jessie had become intimate again. He said there were no expectations for him to leave his family with Kelly. He said that Jessie told him that she was seeing other people. He said that after Jessie called Kelly again, Kelly told him that Jessie was pregnant again. He said that based on the time frame, that the child could have been his. He said he told Jessie that he would take care of the child if it was his, just like he took care of Blake. He said he wasn't sure at the time if it was his since he believed she was having other relationships.

1:15pm Bobby said that he asked Jessie to stop calling Kelly, that it was causing problems for him at home.

1:14pm Bobby said that in 2005, he and his wife separated again and he was again intimate with Jessie during that time. He also testified that each time Jessie contacted Kelly, he would learn about it later from Kelly.

1:11pm Bobby is now talking about the incident involving sex on the patio furniture. He said he did not have sex with Jessie on the patio furniture. He said he wondered why Jessie told Kelly that it had happened. He said there was nothing going on between Jessie and him at the time of the patio furniture claim.

1:10pm Bobby is now talking about the incident when Jessie left her underwear in Kelly's makeup drawer. He confirmed that Kelly threw that underwear at him. Cutts said he first laughed, not knowing why underwear was being thrown at him. He said that prior to that incident, he had never seen the underwear but that Jessie was in the home the day before that incident - he said she used the restroom that day. He also said he told his wife that he had no knowledge of the underwear being there.

1:08pm Once Blake was born, it still wasn't determined if Bobby Cutts was the father. He said that he already treated him like a son though and saw him on a weekly basis. Paternity was established in April, 2005. Cutts also testified that in 2004, he and his wife had reconciled. He said that his wife, Kelly, treated Blake as their own and there were no problems between any of the adults involved.

1:06pm Cutts said he learned in 2004 that Jessie was pregnant. This was the pregnancy which resulted in Blake being born on December 3, 2004. Cutts learned about the birth a couple days after it occurred. He said he never had any conversation about not wanting to be Blake's father, in fact, he was happy to have a son because he had two daughters and always wanted to have a son.

1:04pm Cutts said he met Jessie Davis at an Akron night club. He said that later that night, he had intimate relations with Jessie Davis. He said he was separated from his wife at that time.

1:02pm Cutts testified that he became a member of the Canton Police Department in 2001. He said that Jessie Davis is his son Blake's mother. He said he also calls him Thunder.

1:01pm Court is back in session. Bobby Cutts Jr. is taking the witness stand.

11:38am Only two more witnesses are expected to be called by the defense this afternoon. One of those is expected to be Bobby Cutts, Junior's former partner with the Canton Police Department.

11:26am Judge Brown has just told the jury that there will now be an hour and fifteen minute lunch break. Court will resume at 12:45pm.

11:20am Ranke is finished questioning Weisburn. Chryssa Hartnett asked one question about phone records and Sergeant Weisburn is now finished on the witness stand. Attorneys have requested that he be available for recall.

11:07am Weisburn said that there are two phone lists. A list of the people who owned phones and another list of people who spoke on those phones.

11:04am Weisburn said that he also used Jessie Davis' cell phone records to put names on a list.

11:00am Weisburn is talking about all of the people who were called by Bobby Cutts Junior's home phone and two cell phones. He then made a list of all of those people.

10:56am Sergeant Eric Weisburn has been recalled to the witness stand. He is with the Stark County Sheriff's Department and previously testified as he was one of the first people on scene at Jessie Davis' house on the morning of Friday, June 15, 2007. He is now being questioned about looking at phone records by Defense Attorney, Carolyn Ranke.

10:54am Stauffer is now finished on the witness stand.

10:52am Watson is finished questioning Stauffer. Assistant Prosecutor, Chryssa Hartnett, is now questioning Stauffer. She asked him if he was asked to talk to Mitchell because he was a good friend of Bobby Cutts'. Stauffer agreed. Hartnett is now finished questioning Stauffer.

10:44am Stauffer testified that he spoke with Richard Mitchell and later spoke with his wife Vicki.

10:39am Stauffer did not have his police report with him when he sat on the witness stand. He's now been provided a copy of his report. Watson had asked him who he had interviewed at Allstate Insurance (Jessie Davis' employer).

10:31am Stauffer said that he interviewed Richard Mitchell.

10:28am Stauffer said that he spoke with Terrell Davis and said that he had a former relationship with Jessie Davis.

10:24am Defense Attorney, Myron Watson, is now questioning Stauffer. As part of this case, Stauffer said that he interviewed Michelle Poorman. She is an acquaintance of Richard Mitchell. Mitchell is the one who testified that Bobby Cutts, Junior said that he was going to "kill that b---- and throw her in the woods." Stauffer said that he interviewed Foreman, in part, to find Mitchell.

10:21am Court is back in session. The defense has called Rick Stauffer. He is a Deputy with the Stark County Sheriff's Department.

9:52am The jury asked if there would be blood if someone were killed with asphyxiation. Rini said only if blood had been let at that time. The court is now taking a 20 minute recess and will reconvene at 10:15am.

9:48am Defense Attorney, Myron Watson, came back to ask Rini if he'd ever heard of mulch being used as a masking agent. Rini said no.

9:43am Rini testified that he doesn't know why bleach was poured on the floor of Jessie Davis' bedroom. Hartnett is now finished questioning Rini.

9:41am Rini said that the less blood that exists makes it more difficult to detect.

9:38am Watson is finished questioning Rini. Assistant Prosecutor, Chryssa Hartnett, is now questioning Rini.

9:37am Rini testified that washing clothes would not get rid of the detectable blood in them. He also said that two gallons of bleach wouldn't get rid of blood.

9:33am Rini was just shown the picture of the bleach on Jessie Davis' bedroom floor. He testified that it didn't look like something that was done with the intention of covering something up since it looks more like splashing of the bleach. Rini also testified that he's never heard of bleach being used to speed up decomposition. Rini also testified that he's heard of ammonia being used to revive people.

9:30am Defense Attorney, Myron Watson is questioning Rini. He just asked him if someone were to pour bleach all over an area where there was blood, would the bleach get rid of the evidence of blood. Rini said it would do just the opposite. Rini said that the bleach would actually make it easier to detect blood in that location.

9:20am Rini said that this is his 109th time testifying in court as an expert. He works with blood pattern analysis and also with Luminol tests.

9:14am Gary Rini is now on the stand. He is an independant Forensics Science Consultant. He is a former Denver police officer who was assigned to the forensics department. Also ran the forensics section of the Naperville, Illinois Police Department. He has also received specialized training in blood analysis.

9:12am Hartnett is now finished questioning Graham. Stark County Crime Lab Criminalist, Kylie Graham, is now finished on the witness stand.

9:05am Ranke is finished questioning Graham. Assistant Prosecutor, Chryssa Hartnett, is now questioning Graham. Hartnett asked when the clothing items were collected and Graham said that they were collected on June 20th (Jessie was reported missing on Friday, June 15th). Hartnett asked if some of the clothes were collected from the washing machine and Graham said that some of them were collected from a washing machine. Hartnett asked if Graham knew if any of the clothes were ever worn at Jessie Davis' home and Graham said she'd have no way of knowing. Hartnett asked if laundering clothes would remove any detectable blood and Graham said that it would.

9:02am Graham said that she tested various shirts and a sweatshirt from Cutts' home and found no blood on those items. She said that in a few of the items found in Cutts' home, there were presumptive tests that showed up positive for blood but later tests could not confirm that blood was there.

9:00am Graham said that she tested athletic gloves from Cutts' home and found no blood on them. She said that since there was no blood, there was no DNA test requested.

8:58am Graham has also testified that she did tests on items removed from the home of Bobby Cutts, Junior. She said those items were things like clothing and shoes.

8:56am Graham said that she was called to Jessie Davis' home on the day she was discovered missing on June 15, 2007. She said that this is the only site she went to with regard to this case.

8:53am Kylie Graham is the first witness called by the defense. She is a Criminalist with the Stark County Crime Lab. Attorney Carolyn Ranke is now questioning Graham.

8:51am The jury members have now arrived. As with every day, Judge Brown asked them if they've followed his instructions as to not gathering any information about this case.

8:32am We are waiting for court to be in session. It's expected that the defesne witnesses will last until at least early afternoon. Closing arguments will then take place first thing Tuesday morning.
