Cutts Trial Blog: Friend Says She Saw Cutts Dump Body

3:41pm Judge Brown recessed the trial for the day. Bobby Cutts Jr.'s ex-wife Kelly Cutts will be the third witness called tomorrow. Day two is now over.

3:37pm Hawthorne is finished on the witness stand.

3:30pm Hawthorne said that she thought that Bobby Cutts Jr. was a good dad.

3:25pm Hawthorne said that she alone decided to terminate her pregnancy and made the decision before Wednesday, June 13th.

3:23pm Hawthorne said that Bobby Cutts was never physically or mentally abusive to her. In fact, he was the kind of guy who would joke around.

3:12pm Hawthorne said that on Friday, June 15th, she called Cutts and he said he couldn't talk because something happened to Blake's mother.

3:09pm Hawthorne said that she received a call from Bobby Cutts at about 2:12am on Thursday morning, June 14th. The cell phone records shown in court confirm that. She said she heard the dinging of his truck and assumed he was home. She said she next talked to Cutts the following morning, Thursday, June 14th.

3:02pm Hawthorne said that she decided to terminate the pregnancy and Bobby Cutts knew about the decision. The termination occurred on Friday, June 15th.

3:00pm Hawthorne said that at some point she became pregnant with Bobby Cutts' baby. She said that she learned of the pregnancy in June, 2007.

2:56pm Hawthorne said that she is married and has known Cutts since October, 2006. She also said that she was involved with Cutts romantically. The first time would have been spring of 2007.

2:51pm Denise Haidet is finished on the witness stand. Stephanie Hawthorne is now on the witness stand.

2:46pm Defense Attorney Ranke asked Haidet if she'd ever seen Bobby Cutts Jr. intoxicated and she said that she had. She added that he was not intoxicated on the night of Wednesday, June 13th. Ranke asked if he appeared angry. Haidet said no.

2:41pm Haidet said she later read the newspaper about the missing Jessie Davis. She texted Cutts asking if that was his son's mom and Cutts replied yes. She texted again asking if there was anything she could do.

2:35pm Haidet said that she'd known Cutts for two and a half years and they had dated on and off during that time. She also confirmed seeing Cutts at Champs on the night of Wednesday, June 13th.

2:31pm Ladson is finished on the witness stand. Denise Haidet is up next.

2:27pm Ladson is a barber and cut Cutts' hair. He also said he gave Blake his first haircut. Ladson added that he thought that Cutts is a good father.

2:25pm Defense Attorney Fernando Mack is now questioning Ladson.

2:23pm Ladson confirmed the people who were at Champs and said that Denise Haidet was also there. He then said that he talked to Cutts about the Sheriff's Department wanting to talk to him (Ladson) and Cutts told him to tell the truth. Ladson said he also talked to the FBI.

2:19pm James Ladson is now on the stand. He said that he and Bobby Cutts Jr. were pretty good friends.

2:11pm Davidson confirmed that he played softball that night and then went to Champs. Later, James Ladson and Bobby Cutts showed up as well--along with Davidson's girlfriend.

2:04pm Larry Davidson is finished on the witness stand. William Moses is next. He is one of two men who were with Bobby Cutts, Jr. on Wednesday night, June 13th at Champs bar.

1:58pm Defense Attorney, Myron Watson, is now questioning Larry Davidson.

1:55pm Court is back in session. Larry Davidson is now on the stand. He's a friend of Myisha Ferrell's and also Bobby Cutts' cousin. He is confirming that he drove Ferrell back and forth to Cutts house on Thursday, June 14th and at other times. He also said that he drove her to work during that time.

1:27pm Judge Brown has called for a 20 minute recess.

1:20pm Lombardi is finished and Ferrell's friend, Adreina Snell is now on the witness stand. She was with Ferrell on Wednesday night, June 13th. She was with Ferrell when Cutts arrived early on Thursday morning. She's confirmed what we heard from Ferrell and is now excused from the witness stand.

1:14pm Lombardi confirmed that he saw Cutts driving in his personal truck around 6am on Thursday, June 14th.

1:10pm Officer Mike Lombardi with the Canton Police Department is now on the witness stand.

1:08pm A question was asked if Ferrell saw the bite mark on Cutts' finger. She replied yes. Myisha Ferrell is finished on the witness stand.

1:05pm The jury is now posing questions for Myisha Ferrell.

1:00pm Watson said that Cutts had never been violent in the past and Ferrell agreed.

12:55pm Defense Attorney, Myron Watson is now questioning Ferrell.

12:52pm Ferrell said she later went home. A Sheriff arrived and she told him that she was supposed to babysit Blake. She then went back over to Cutts' house. Cutts' mother was there at the time.

12:49pm Ferrell said that on Saturday, June 16th, Cutts' cousin Larry Davidson came over and was going to take her to Cutts' house. She was supposed to wait for a Sheriff to show up but since he didn't show, she went to Cutts' house. Once there, Cutts told her that the Sheriff was going to talk to her and to tell him that she was supposed to babysit Blake.

12:47pm Ferrell said Cutts called him the next day and said his baby's mom was missing. She said she thought he was crazy at that point.

12:42pm Ferrell said that Cutts called Jessie's cell phone on the way home. She also said that she threw a pink cell phone out the window. She said that Cutts stopped to spray out the back of the truck with water and later picked up mulch and put it in the back of his truck. Ferrell then said that Cutts gave her $100 and said he wished he could give her more. She said that he asked if she could see marks on his chest and she said they were vague. She said Cutts also told her that the cut on his finger was from Jessie biting him.

12:39pm Ferrell said they stopped in a field and stopped the truck. She said that Bobby got out to get the body out. Ferrell said she saw feet sticking out and she didn't want to see anything else. She said that Bobby wasn't gone very long after he left with the body.

12:35pm Ferrell said Cutts made a gesture with his arm after she asked what happened. They were travelling north on I-77. They stopped at a truck stop for Myisha to use the bathroom.

12:32pm Ferrell said Cutts said that something was wrong with his baby's mother. He then said that Jessie was in the back of the truck. Ferrell said she didn't understand that at first.

12:29pm Ferrell said she got in Cutts' truck with him and they left.

12:27pm Ferrell said Cutts appeared dysfunctional.

12:26pm Ferrell said that on the night of Wednesday, June 13th, she was up drinking and smoking marijuana. When her friends were leaving her house, early on Thursday morning, around 6am, Bobby Cutts Jr. was at her house.

12:25pm The trial has resumed. Myisha Ferrell is now on the stand explaining that she must testify truthfully in this case as part of her November plea deal.

11:14am Judge Charles Brown has told the jury that the court will take an early lunch today because he doesn't like to split witnesses between sessions. Myisha Ferrell, Cutts' high school friend, will take the witness stand after lunch. Judge Brown has asked everyone to return at 12:15pm. Lunch break.

11:08 am The jury is allowed to ask questions of witnesses. Weisburn was asked if he knew when Cutts left Hawthorne's house. Weisburn said that it was around 2am on the morning of Thursday, June 14th.

Stark County Sheriff's Dept. Sgt. Eric Weisburn is now finished on the witness stand.

11:05am Hartnett asked Weisburn if Cutts told him if he went to Stephanie Hawthorne's house after going to Champs bar. Weisburn said he did not. Hartnett asked if Cutts told him if he went to Jessie's home after leaving Champs bar. Weisburn said he did not.

11:04am Court is back in session. Prosecuting Attorney Chryssa Hartnett is now cross examining Sgt. Weisburn.

10:26am Weisburn is still on the stand. The Judge has ordered a 30 minute break.

10:15am Weisburn continues to testify. After he's finished, it's likely that there will be a 15-20 minute break before Myisha Ferrell takes the stand.

10:03am Weisburn says that through the investigation, he learned that after Cutts was at Champs bar on the night of Wednesday, June 13th, he then went to the home of Stephanie Hawthorne. He told Weisburn earlier that he had gone home from Champs bar. Mack suggests that the reason that Cutts didn't tell Weisburn is because Hawthorne was married but separated.

9:57am Mack asked Weisburn if he believes everything that a 2-year old tells him and Weisburn said no. Mack said that Blake also said something about Mommy making him pancakes and there was no evidence of pancakes being made. Weisburn agrees. Mack says there's no way of knowing when Blake is talking about or even if it's true. Weisburn agrees.

9:51am Mack asked if Weisburn taped the interview with Blake. He said no.

9:49am Weisburn again stated that he interviewed Bobby Cutts Jr. in Jessie Davis' driveway on the morning on Friday, June 15th He then said that he went next door and talked to Blake Davis. He told Mack that Blake said, "Mommy's crying, mommy broke table, mommy's in rug."

9:43am Weisburn said that through the investigation, they found that Blake's DNA was on the bleach bottle. Mack asked Weisburn if they determined that Cutts' DNA was NOT on the bleach bottle. Weisburn said that he could not agree with that statement.

9:35am Mack is asking Weisburn about arriving at the scene of Jessie's home on the morning of Friday, June 15th. He's describing images that we've already heard about -- purse on the kitchen floor, mattress moved, bleach on the bedroom floor and table pushed over in the bedroom.

9:28am Mack has asked Weisburn if the only home that he searched, after Jessie went missing, was that of Bobby Cutts, Jr. Weisburn said yes.

9:22am After Weisburn is finished, Cutts' childhood friend Myisha Ferrell will take the witness stand. Prosecutors claim that Bobby Cutts confessed to Ferrell that he killed Jessie Davis.

After Ferrell, other notables on the witness list for later in the trial are William Moses and James Ladson - the two men who were at Champs bar with Cutts the night of Wednesday, June 13th. Also Stephanie Hawthorne, whom Cutts was in contact with during the time of Jessie's disappearance. Cutts' ex-wife Kelly will also testify.

9:18am Defense Attorney, Fernando Mack is now questioning Weisburn. He first asked if Cutts told him in the car ride to Hampton Hills how the body ended up there. Weisburn said no.

9:14am Hartnett just showed the picture of Jessie Davis' badly decomposed body with a red comforter near it. You can also see the form of a small body as well. The bodies were almost black in color.

After Hartnett took the picture down, Cutts was seen taking off his glasses in the courtroom. His attorney, Carolyn Ranke said a few words to him as Cutts then took a deep breath.

Weisburn then confirmed that Boddy Cutts Jr. was arrested that day, Saturday, June 23rd. Weisburn also identified Cutts in the courtroom.

A few moments later, Cutts was seen looking skyward.

9:11am Hartnett is now showing pictures of the Metropark scene and having Weisburn describe them. The first picture is the dirt road with authority cars parked along the side of the road.

9:05am Weisburn is telling Hartnett that Bobby Cutts Jr. came into the FBI office on the morning of Saturday, June 23rd and told authorities where to find Jessie's body. He gave directions up 77 North and the Ghent Road exit and then said that her body would be in tall grass. Weisburn said when they got there (Cutts was with them), they couldn't find the body and Cutts told them to go down a dirt road. They continued looking and weren't having much luck in finding a dirt road.

Weisburn said they stopped and talked to Cutts about a cell phone call that he had made on Thursday morning, June 14th and that authorities knew that his cell phone call had hit a tower in that Summit County location. They asked Cutts if he still had the body when he made that phone call and Cutts said yes. He said he disposed of the body shortly thereafter. Cutts then took authorities to the spot where the body could be found and that's where Jessie's body was found - in the Hampton Hills Metropark.

8:59am If you're watching the streaming video of the trial on newsnet5.com, there will be times when you can't hear what's going on in the courtroom. This is because the attorneys are meeting with the Judge and he's asked that the microphones be turned off at that time.

8:55am Weisburn continues to talk about cell phone records and also trying to use security camera images to try to determine where Bobby Cutts was in the early morning hours of Thursday, June 14th.

Bobby Cutts Jr. is in the same place in the courtroom that he was yesterday. As we look into the courtroom, the defense table is set up left to right; Myron Watson, Carolyn Kaye Ranke, Bobby Cutts Jr., Fernando Mack. Next to Mack is the Prosecution's table. Left to right, Stark County Prosecutor, John Ferrero, Chryssa Hartnett (who's currently questioning Weisburn) and Dennis Barr.

So far in the courtroom, we've seen Ned Davis (Jessie's father) and at least one of Jessie's sisters.

8:47am Day 2 of the trial is underway. Myisha Ferrell was supposed to be the first witness on the stand today, but Sgt. Weisburn has not finished on the witness stand. He is currently going over cell phone records with Asst. Prosecutor Chryssa Hartnett. The cell phone records being discussed are those of Bobby Cutts.

Weisburn just stated that while Cutts told him that he made a certain phone call from his home, the records show that he was not at home while making that call.
