Man Plans To Sue Companies In Small Claims Court

CLEVELAND -- Some people have problems with junk faxes just like they have a problem with junk mail, spam and telemarketers, according to NewsChannel5.
"They just started coming in every couple of weeks," Don Guadagni said. "It was a nuisance to me. I am a great believer in privacy in one's home that extends to electronic privacy."
After getting frustrated because of his paper and ink costs were skyrocketing, he fought back by using the Consumer Protection Act.
He tracked down the senders and took them to Small Claims Court.
WEWS said that under the ALW, once you are sent the first fax, you may take action without any notification to them and we want it to stop.
And if they don't stop, Guadagni could get $500 per violation and as much as $1,500 if the company knowingly violates the law.
Both companies in the Guadagni case are fighting the claims. One even filed a counter-lawsuit.
"We're gonna fight it out because it needs to stop," Guadagni said.
If you receive a fax, call the company and ask a representative to remove you from their list.
Also complain to the state attorney general and the Federal Communications Commission.
If they still don't stop, file a suit in a small claims court.
