CLEVELAND - Jimmy Dimora will not be spending time at the resort-style backyard of his Independence home this summer.
A federal appeals court denied Dimora's request for pre-sentencing release on Thursday, and agreed with initial denial by U.S. District Court Judge Sara Lioi.
The three-judge panel at the 6th U.S. Circuit Court of Appeals in Cincinnati agreed the former commissioner should be considered a flight risk.
"His family and community enabled and/or participated in his offenses," the ruling said. "His medical conditions are readily controlled by medication and other means, and he is receiving medical care while incarcerated. Further, he was convicted of multiple offenses involving fraud, deception, and obstruction of justice."
Dimora is set to be sentenced on corruption charges on July 25. His co-defendant, Michael Gabor, will be sentenced on the same day and also was denied pre-sentencing release in court documents.
In other corruption-related developments, court documents show Frank Russo changed his address, but his new living arrangements are sealed. The former auditor cut a plea deal with prosecutors and agreed to testify against his former friends in exchange for a reduced sentence.
A sentencing date for Russo has not been set, pending his testimony at other scheduled trials.
Over the course of the government's corruption investigation, judges, county officials and businessmen were convicted, and the trials are not over yet.
