Brecksville man gets 5 days in jail for car accident that killed Avon bridge painter

AVON, Ohio - A 50-year-old Brecksville man will spend five days in jail for a September accident that killed a bridge painter.

Anthony Rose, 50, was driving west on I-90 in Avon when authorities said the car in front of him braked. Rose hit that car and then swerved through orange barrels, hitting and killing 63-year-old Peter Maglis.

In court, Rose apologized numerous times for the deadly accident.

An Avon police officer testified that Rose stopped at the crash scene and was emotional and remorseful. The officer and Rose's attorney also stated the posted speed limits by ODOT were confusing in the construction zone.

Judge Darrel Bilancini also noted there were questions about improper speed limit signs in the construction zone near the Nagel Road interchange.

Rose told NewsChannel5 after court that he wants to work with local and state officials to change the law and make construction zones safer. Rose said there should've been a concrete barrier to protect construction workers and the posted legal speed limit should have been reduced.

The 90 day jail sentence, 85 which were suspended, was because the judge felt there were no aggravating circumstances in the case and that Rose was not on a cellphone.

Aside from spending five days in jail, Rose was fined and also given community service.

Rose earlier pleaded guilty to vehicular manslaughter and failure to keep an assured clear distance.
