Cleveland Municipal Court judges recused from City Councilman Eugene Miller DUI case

CLEVELAND - Another judge will have to be brought in to hear the case involving City Councilman Eugene Miller, arrested and charged with DUI.

Miller, who represents Ward 10, was scheduled to be in court Tuesday but Judge Angela Stokes as well as all other Cleveland Municipal Court judges have been recused from hearings and any further proceedings in the case.

The Cleveland City Council controls court budget, which would present the potential for a conflict of interest.

Miller was pulled over by police near Route 2 and Marginal Road at 1 a.m. Sunday, Nov. 25 for speeding. He told the officer he was heading home from watching a Notre Dame football game.

Miller pleaded not guilty to driving under the influence. Court officials told NewsChannel5 that Miller's blood alcohol content was .056, which is under the legal limit.
