Cuyahoga County judge sides with Cleveland's trans fat ban on selling artery-clogging foods

CLEVELAND - An Ohio judge has sided with Cleveland in its lawsuit seeking to invalidate the state law blocking a city ban on selling prepared foods that contain artery-clogging trans fats.

Cuyahoga County Judge Nancy Russo ruled this week that the law was an unconstitutional attempt to stop the city from exercising its home rule rights under the state constitution.

The city ordinance, which passed last year, would ban industrially produced trans fats in restaurant meals and grocery and bakery takeout items.

A spokeswoman for the city says officials were pleased with the ruling, and said the regulation protects Cleveland citizens.

The Ohio Attorney General's Office says it is aware of the ruling and is reviewing it to determine further action.
