Passenger Sues City Over Chase, Fatal Shooting

Man Claims Police Lied About Collision With Cruiser

POSTED: 11:47 am EDT September 4, 2008

The passenger in a car involved in a pursuit with Blue Ash police that ended in the driver's death is suing the city.

Daryl Black was in a stolen car with Charles Bennett last September when an officer tried to pull over Bennett for driving without lights, WLWT in Cincinnati reported.

A chase ensued that ended with a damaged police cruiser, two injured officers and Bennett's death, when officers fired through the windshield of the car.

Authorities determined that Black was an innocent bystander in the incident.

But this week, Black filed a lawsuit against Blue Ash, claiming that conditions didn't warrant a high-speed chase. Black also said officers lied about the cruiser being rammed.

Black is seeking unspecified damages.
